Trip Terms & Hold Harmless Agreement
Important: Carpoolable is a platform for members to self-organize transportation sharing. It does not provide transportation and does not guarantee a ride, driver, route, timing, safety, insurance coverage, cost arrangement, or match.
Member responsibility and voluntary participation
Each member independently decides whether to create, request, offer, approve, join, or take a Trip. Drivers are responsible for maintaining any license, vehicle condition, and insurance required by applicable law. Passengers and drivers are responsible for their own travel decisions, communications, belongings, and any cost-sharing arrangements. Carpoolable does not collect payment for a specific Trip.
Cancellation, no-show, emergency, and backup transportation
Trips may be cancelled, changed, delayed, declined, or missed, and a driver or passenger may not show. Confirm details directly and keep a safe backup transportation plan. Do not rely on a Trip for emergency transportation. If you are stranded, feel unsafe, or need urgent help, contact local emergency services when appropriate and use a trusted contact, licensed transportation, or another safe alternative.
Hold harmless, release, and indemnity
By using Carpoolable, the User agrees to hold harmless and indemnify Carpoolable, its officers, directors, employees, and agents from claims, damages, liabilities, losses, or expenses arising from or related to the use of Carpoolable. The User acknowledges the inherent risks of transportation, including accidents, property damage, personal injury, delays, and unexpected travel expenses, and assumes those risks.
The User agrees to release, discharge, and waive claims, actions, or causes of action against Carpoolable arising from or related to a Trip organized using Carpoolable's information infrastructure, including claims for negligence, breach of contract, or another theory of liability. The User also agrees to indemnify and hold Carpoolable harmless against third-party claims or demands arising from use of Carpoolable. This agreement survives termination and is binding on the User and their heirs, successors, representatives, and assigns.
Scope and review notice
This document supplements and preserves the Insurance page's existing Terms & Conditions/Hold Harmless Agreement; it does not replace applicable law or any rights that cannot lawfully be waived. The targeted additions concerning no-shows, backup transportation, emergencies, and platform non-guarantees are intended for counsel review. Carpoolable does not represent that qualified counsel has approved this text.
